The Fairborn Municipal Court serves the communities of Fairborn, Bath Township, Beavercreek and Beavercreek Township.

The court conducts preliminary hearings in felony cases, handles traffic and non-traffic misdemeanors, and civil cases where the money in dispute does not exceed $15,000. The Greene County Common Pleas Court (Xenia) handles felony criminal cases.

The purpose of this website is to provide public access to case information maintained by the Clerk of the Fairborn Municipal Court. Due to the applicable provisions of Ohio law regarding privacy and confidentiality, not all case information is available to the public through this website.

Press Releases

Judge Beth W. Cappelli of the Fairborn Municipal Court received the Charles Christopher Award for exceptional service for 2017 from the Mental Health and Recovery Board of Clark, Greene and Madison Counties (MHRB) at its annual ceremony. The Charles Christopher award is given annually by MHRB to a person who has made outstanding contributions to alcohol and drug recovery services in Greene County, Ohio. MHRB recognized Judge Cappelli as a person of excellence due to her continuing involvement in substance abuse recovery services, which include her management of the Fairborn Municipal Drug Court.

Although recognized individually, Judge Cappelli acknowledged her court staff and the collaborative effort from many local agencies, including MHRB, TCN and the local law enforcement agencies, as they collectively attempt to address the persistent criminal behaviors related to addiction and abuse and provide recovery services to needy individuals.

Judge Beth W. Cappelli, of Fairborn Municipal Court announced her court has been awarded $40,679.06, in Technology Grant Funds from The Supreme Court of Ohio. The Supreme Court has a competitive process and provides grants to assist Ohio courts and justice partners in funding upgrades to operations, innovative justice initiatives and more. Each grant type is targeted to a specific need or use. These funds will be utilized to purchase a new metal detector and x-ray scanner for the Court to improve security operations.

Expedited Record Option with Application for Sealing of Record

Summary:

Ohio Revised Code § 109.38 was implemented to assist individuals whose record is Sealed/Expunged per a court order in having the record promptly removed from background check companies.

In February 2018, Higbee and Associates (Selected Vendor) established a portal for those who have chosen to Opt In to the Expedited Record Update Service when the Court Grants a Sealing/Expungement.

What is Required?

The Court is required to provide notice there is an opportunity for the individual filer/Attorney of Record to Opt In or Opt Out of this service at the time of filing the Application for Sealing/Expungement. Court clerks will provide this form at the time of filing if the applicant does not have the form. This form is located in the Forms Tab on the court’s website: www.fairbornmunicipalcourt.us

The expedited record update service form must be completed at the time of filing. If an Attorney or individual is filing via US Mail, this form must be included with the application for sealing, along with the cost for the sealing of $50.00 as well as the $45.00 fee that is required to be paid at the time of filing. The $45.00 fee is placed on-deposit until the Application for Sealing/Expungement is Granted or Denied by the Court. If the court denies the application, the $45.00 fee is refunded to the individual. If the sealing is granted, the $45.00 is submitted to Higbee & Associates. There is only one (1) fee of $45.00 per individual even if the defendant had multiple cases.

Effective September 11, 2017
Pursuant to an Order of the Court dated September 11, 2017 the deposit for a jury trial in all civil cases has increased from $500.00 to $1,000.00.

Effective October 15, 2014
No wireless communication devices (including without limitation, cellular phones, laptop or notebook computers, iPods, etc.) are permitted in the building.
